These Terms of Service (the Terms) are a binding agreement between you and Bachata Studio, the digital service available at bachata-musicality.com. Please read them carefully. By creating an account, making a purchase, or using the service, you agree to these Terms. If you do not agree, please do not use the service. These Terms are not legal advice.
Who We Are
Bachata Studio is operated by TheTotalFocus, a sole proprietorship registered in Poland at Ludwiki 4b, 01-226 Warsaw, Poland. This is the same business behind thetotalfocus.com.
You can reach us any time at support@thetotalfocus.com or +48 733 867 905. In these Terms, we, us, and our mean this business, and you and your mean the person using the service.
Bachata Studio is a digital subscription web app for practicing bachata musicality. You can build song flows, keep a figure library with your own videos, and play practice games. It is an online service, not an e-book, download, or physical product.
Eligibility
To hold an account you must be at least 16 years old. This is the minimum age for digital consent in Poland, where we are based. If you are under 16, please do not create an account.
Anyone can pay for a plan. There is no separate age barrier at checkout. When you make a purchase, you simply acknowledge that you are allowed to make it, meaning you are 18 or older, or you have your parent or legal guardian's permission. It is a quick acknowledgement, not a hurdle.
If a minor makes a purchase without permission, a parent or legal guardian can contact us at support@thetotalfocus.com and we will help sort it out, including a refund where appropriate.
Your Account
You need an account to use most of the service. You are responsible for keeping your login details secure and for activity that happens under your account. Please tell us promptly at support@thetotalfocus.com if you think someone else has accessed your account.
You may close your account at any time from your account settings or by emailing us.
Accuracy of Information
When you create an account or make a purchase, please give us accurate and current information, including your email and any billing details. Keeping this information up to date helps us deliver the service, send important notices, and process payments and refunds correctly.
The Service and Changes
We are always improving Bachata Studio. We may add, change, or remove features, and we may occasionally take the service offline for maintenance. We aim to keep the service reliable but we cannot promise it will always be available or uninterrupted.
If we plan a change that materially reduces the core value of a plan you have paid for, we will act reasonably and, where appropriate, let you know.
Plans, Subscriptions, and Billing
Bachata Studio offers three ways to access the service:
- Free plan: a limited version of the service you can use at no cost.
- Monthly subscription: recurring access that renews automatically each month until you cancel.
- Lifetime purchase: a single one-time payment for permanent access, with no recurring charges.
Make an offer pricing
We set pricing through a Make an offer process at /offer. You propose a price in the currency you choose (USD, EUR, GBP, or PLN). We then either approve it as a monthly price or as a one-time lifetime price, or we decline with a short message. If we approve your offer, the amount you proposed is charged through Stripe for the plan we approved it as. Nothing is charged unless and until an offer is approved.
Automatic renewal
Payments and taxes
Payments are processed by Stripe. We do not store your full card details. Prices are the amount you offered and we approved. Depending on where you are, applicable taxes such as VAT may be added or included as required by law; where that applies it will be reflected at checkout or on your receipt.
Cancellation
You can cancel a monthly subscription at any time, and cancelling is as easy as signing up. You can do it yourself through the Stripe customer portal or your account settings, or by emailing support@thetotalfocus.com.
When you cancel, your access continues until the end of the period you have already paid for, and you will not be charged again. Cancelling stops future renewals; it is separate from a refund, which is covered below.
Price Changes
If we ever change the price of a recurring subscription, we will email you in advance. A price change never applies to a period you have already paid for. If you do not want the new price, you can cancel before it takes effect and it will not be charged.
Refunds
Paid plans give you immediate access to a digital service. At checkout you consent to that immediate start and acknowledge that you give up your 14-day right of withdrawal once your access begins — so paid plans are non-refundable after your access has started. You can still cancel a monthly subscription at any time to stop future renewals.
- Lifetime purchase: non-refundable once your access has begun, because you asked for and received immediate access.
- Monthly subscription: non-refundable once your access has begun. You can cancel any time to stop future renewals; cancelling ends future charges but does not refund a month you have already started.
- Billing errors or duplicate charges: contact us and we will fix them.
This does not affect your mandatory statutory rights. If the service is faulty, not as described, or not provided, consumers in the EU, EEA, and UK keep their legal remedies and we will honour them; we also correct genuine billing errors such as duplicate or incorrect charges. Billing and Account Accuracy
Please keep your billing and contact details accurate and current so payments, renewals, and refunds process correctly and so you receive important notices such as advance price-change emails. If a payment fails, we or Stripe may retry it, and access may pause until payment is completed. If you spot anything wrong with a charge, email support@thetotalfocus.com.
Intellectual Property and Your License to Access
Bachata Studio, including its software, design, text, graphics, and other materials we provide, is owned by us or our licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the online service for your own practice, according to your plan and these Terms.
This is a license to access an online service. It is not a sale of the software, and it does not give you the right to copy, resell, redistribute, reverse engineer, or create derivative works from the service, except where the law allows.
Your Content
You keep all rights to the content you upload or create, including your figures, videos, and flows. We do not claim ownership of it.
To run the service, you grant us a limited, worldwide, non-exclusive license to host, store, process, and display your content back to you (and to anyone you deliberately share it with) purely so the service can function. This license lasts only as long as we need it to provide the service to you, and it ends when you delete your content or close your account, subject to routine backups and any retention the law requires.
You are responsible for what you upload. You confirm that you own or have the rights to your content and that sharing it with us to run the service does not break the law or anyone else's rights.
Third-Party Services
We rely on trusted providers to run Bachata Studio:
- Stripe, Inc. (USA) processes payments.
- Convex, Inc. (USA) provides our backend, database, and account infrastructure.
- Vercel, Inc. (USA) provides hosting.
- PostHog, Inc. (USA) provides product analytics (PostHog Cloud US).
Your use of the service also involves these providers, and their handling of data is described in our privacy policy at /privacy. We are not responsible for the independent acts of third parties, but we choose our providers with care.
Analytics and Cookies
Essential cookies (for sign-in and session, and for Stripe fraud and payment) are always on because the service cannot work without them.
Product-analytics cookies (PostHog) work differently depending on where you are. For visitors in the EU and EEA and the UK, analytics are off by default and only turn on after you accept them in our cookie banner; you can decline, and you can withdraw consent at any time in Cookie settings. For visitors outside the EU, EEA, and UK, analytics are on by default and you can opt out at any time in Cookie settings.
We are not cookie-free, and analytics are not universally off until you say yes; the behavior is geo-differentiated as described above. Full details are in our privacy policy at /privacy.
User Conduct
When using Bachata Studio, please do not:
- break the law or infringe anyone's rights, including copyright, in what you upload or do;
- upload content you do not have the rights to use;
- try to disrupt, overload, hack, or reverse engineer the service or get around its security;
- share your account or resell access in ways these Terms do not allow;
- misuse other people's content that you can see through shared or public features.
We may remove content or suspend accounts that break these rules.
Disclaimer of Warranties
The service is provided as is and as available, to the fullest extent permitted by law. We do not promise that it will be uninterrupted, error-free, or fit for a particular purpose beyond what the law requires. Nothing in this section limits rights that consumers have under mandatory law, including Polish and EU consumer protection rules, which continue to apply.
Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential losses, or for lost data or profits, arising from your use of the service. Where we are liable, our total liability is limited to the amount you paid us for the service in the 12 months before the event that gave rise to the claim.
Nothing in these Terms excludes or limits our liability where the law does not allow it, including for death or personal injury caused by negligence, for fraud, or for any mandatory rights that consumers have under Polish and EU law.
Indemnification
To the extent permitted by law, you agree to cover reasonable losses and costs we incur that arise from your breach of these Terms, your misuse of the service, or content you upload that infringes someone else's rights. This does not reduce any mandatory consumer rights you have.
Severability
If any part of these Terms is found to be invalid or unenforceable, the rest stays in effect, and the invalid part is applied as closely as possible to its original intent within the limits of the law.
Termination
You can stop using the service and close your account at any time. We may suspend or end your access if you seriously or repeatedly breach these Terms, or if we are required to by law. Where it is fair to do so, we will give you notice. If we end your paid access without good reason, we will refund any period you paid for but cannot use. Sections that by their nature should survive, such as intellectual property, disclaimers, and limitation of liability, continue after termination.
Governing Law
These Terms are governed by the laws of Poland and applicable European Union law. If you are a consumer, you also keep the protection of any mandatory laws of the country where you live. Disputes fall under the jurisdiction of the Polish courts, without affecting your right as a consumer to bring proceedings in your home country where the law allows.
Dispute Resolution
If something goes wrong, please contact us first at support@thetotalfocus.com. Most issues are resolved quickly and informally, and we would always rather fix a problem directly.
If we cannot resolve it together, EU consumers can use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Using these options does not take away any rights you have to go to court.
Changes to These Terms
We may update these Terms from time to time. If we make a material change, we will update the Last updated date and, where appropriate, let you know by email or in the app. Continuing to use the service after a change means you accept the updated Terms. If you do not agree, you can stop using the service and cancel.
